The 39th Circuit Court comprises of adults and sometimes juveniles, sentenced as adults, and convicted of felony offenses for which the statutory maximum is more than one year. Ultimately, these offenders can be sentenced to the state's prison system which is under the jurisdiction of the Michigan Department of Corrections.

Probation supervision is as an opportunity to be supervised in the community under the authority of a Judge, as opposed to prison incarceration. Some offenders are sentenced to prison incarceration; however, these offenders who have served time in prison can be, if eligible, paroled. Parole is a period of supervision in the community after a prison term.

2A District Court Probation is an alternative to incarceration which allows an offender to live and function within a community under the supervision of a probation agent.
