Enhanced
Treatment Court Program Phases, Sanctions, and Incentives
PHASE I:
Phase
I is a minimum of two months in order to establish a baseline of functioning. Participants
will be required to meet the following standards while in phase I:
§ Attendance at ET
Court and probation reporting on a minimum once weekly basis
§ Must meet with
providers (case manager/psychiatrist) as scheduled
o
Complete
treatment plan with specific, measurable goals for success in treatment and in
the program. This will establish how often participant meets with provider.
§ Take all
medications as prescribed
§ Attend drug and
alcohol treatment as scheduled. (This includes engagement group/12 step
meetings/individual therapy)
§ Comply with the
color system drug testing as ordered
§ Complete community
service work, minimum of 30% of hours (if ordered)
§ Create a plan
for education and employment goals to be met by program graduation
§ Establish a
Primary Care Physician
§ Pay court fees
and restitution on a regular basis
Participant
will be considered for phase II when the above standards are met.
Depending
upon an offender’s level of functioning, s/he may also be encouraged to do the
following in Phase I:
§ Seek and
participate in employment training
§ Obtain employment
or apply for SSI/SSDI benefits
§ Continue with
community service after completion of hours
§ Obtain a GED
§ Work with
housing providers to secure appropriate housing
PHASE II:
Phase
II will span an average of 4-6 months. The following standards are expected
from participants in phase II:
§ Attendance at ET
Court and probation reporting minimum every other week
§ Attendance at
all treatment appointments (psychiatrist/therapist/etc.)
§ Case Management
contacts may decrease at this time at case management discretion.
§ Attend drug and
alcohol treatment as scheduled. This includes engagement group/12 step
meetings/individual therapy
o
These
appointments may decrease or increase at the discretion of the treatment
provider
§ Comply with the
color system drug testing as ordered
§ Complete at
least 50% of hours of community service (if ordered)
§ Treatment plan
should start to show completion of short term goals (applying for work,
applying for disability, maintained period of sobriety, etc.)
§ Demonstrate
consistent payment on fines and costs.
Participants
will be permitted to advance to Phase III when they have consistently
demonstrated the following:
§ Compliance with
ALL treatment recommendations and probation requirements
§ Minimum 4 months
sobriety
§ 50% of ordered
community service completed (if applicable)
§ 50% of fines and
costs paid (if employed)
PHASE III:
Phase
III will span an average of 4 to 6 months. The following standards are expected
from participants in phase III:
§ Attendance at ET
Court and probation reporting once monthly
§ Attendance at
all treatment appointments (psychiatrist/therapist/etc.)
§ Medication compliance
and sobriety (confirmed with testing).
§ Attend drug and
alcohol treatment as scheduled. This includes engagement group/12 step
meetings/individual therapy

These
appointments may decrease or increase at the discretion of your probation
officer and/or treatment provider
§ Community
service hours are completed (if ordered)
§ Define long term
education/work goals (seek help with vocational agency or case manager if
needed)
§ Stability with
housing and finances have been maintained
§ Fines and costs
consistently being paid
Participants
will move to Phase IV when they have demonstrated the following:
§ Treatment goal
adherence/on track in treatment
§ 75% of fines and
costs have been paid (if employed)
§ Community
service work completed
§ Maintained
sobriety of 6 months
PHASE IV:
Phase
IV will last minimum 4 months, resulting in Graduation from Enhanced Treatment
Court. Participant will participate in the following standards:
§ Attend all ET
Court hearings and probation reporting minimum once monthly unless otherwise
ordered
§ Continue to meet
with treatment on basis according to treatment plan (psychiatrist, case
manager, therapist, etc.)
§ 90 days of
sobriety in order to graduate: remain compliant with any ordered therapeutic or
drug/alcohol testing
§ No missed
treatment appointments in this phase
§ Remains in safe,
stable housing
§ Has achieved
100% of goals identified in treatment related to ET Court participation
§ All terms of
probation have met including all fines and costs paid in full
§ Creates a long
term recovery plan to minimize symptoms and to maximize benefit of program
participation
GRADUATION:
Participants
will be considered for graduation upon completion of Phase 4 requirements. A
participant may be released from probation at this time, or may be required to
follow up with probation officer for a period of time after the program at the
court’s discretion.

*Please note: ET Court program phases are not based only
on time frames; they are also based on participant’s willingness to complete
probation, sobriety, and treatment compliance. All participants will
move through phases at different paces. The incentives and sanctions listed
above can be placed at any point in a participant’s time in ET Court.
